Welcome to Bebs, a multipurpose Dating, Social Networking, and E-commerce App. The following Terms of Service (the «Terms») apply to your use of the Bebs mobile application (the «App») and any services provided by Beber Inc, 8 The Green Ste A Dover, DE 19901 («Beber Inc», «we», «us», or «our»). By using the App, you agree to be bound by these Terms, our Privacy Policy, Community Rules and any other policies or guidelines posted on the App (collectively, the «Agreement»). If you do not agree to the Agreement, you may not use the App.

1. Legal Basis of this Terms of Service

This Terms of Service is an electronic record in the form of an Electronic Contract formed in compliance with the Federal and Delaware State Laws of the USA. This Terms of Service does not require any physical, electronic, or digital signature.  This Terms of Service is a legally binding document between You and the Bebs. The terms of this document will be effective upon your acceptance of the same (directly or indirectly in electronic form, by clicking on or by the Service of the Application, or by any other means), and will govern the relationship between You and Bebs for your use of the App.

2. Formation of This Agreement

Your access to, and browsing, review, and use of the App is subject to these Terms of Service and all applicable laws. By accessing and using the App, you accept these Terms of Service, without limitation or qualification. If you do not agree to the Terms of Service, do not use the App. If, at any time, any part of the Terms of Service is no longer acceptable to you, immediately terminate the use of the App.

3. Eligibility

The services of the App are available only to persons who are competent to enter into a legally binding contract, that is 18 years or above, under the US Laws, or the age of majority in your jurisdiction. Individuals who are not competent to enter into a contract under this act are not eligible for the services provided for this App and hence shall not register as a user or transact on this App. 

4. User Content and Attachments

The App provides a platform for users to send each other media attachments such as photos and videos. All attachments are blurred by default. Users are solely responsible for the content they send, and the App is not responsible for the communication between users and the possible consequences of such communication. The App is not responsible for psychological and emotional losses that the user may suffer. The company does not store user messages and attachments on its servers, all attachments, and messages are stored on users' devices. Users cannot edit the content they send, and the correspondence after sending cannot be edited.

5. User Data

The App stores user data, including phone number, name, gender, gender preferences, geolocation data, ZIP code, photos, text data uploaded to the corresponding public sections of the user profile, marital status, purpose, sexual orientation, date of birth, height, place of study, place of work and position, interests, information about smoking, information about drinking, information about pets, zodiac sign, hair color, eye color, favorite movie, favorite TV series, information about what makes you angry, favorite quote, information about what makes you laugh, and information about the user provided in relevant sections. The App does not store text messages, photos, videos, and audio attachments in messages. They are stored on the server in encrypted form until the user downloads them to his/her phone. Such data is not available to Bebs and anyone else, except for the users between whom the correspondence is conducted. After downloading, such data is automatically deleted from the server and stored only on users' devices. After deleting the account, the user's information is still stored on the server. There is no data retrieval or migration system in place.

6. Content on the Services & Intellectual Property Rights

Intellectual Property All content on the App, including but not limited to trademarks, logos, images, text, graphics, and software, is the property of Beber Inc or its licensors and is protected by United States and international copyright laws. You may not use, reproduce, distribute, or create derivative works from any content on the App without our prior written consent.

Bebs does not claim any intellectual property rights over the Materials (which includes but is not limited to photos, images, videos, graphics, written content, audio files, code, information, or data uploaded, collected, generated, stored, displayed, distributed, transmitted or exhibited in our App/Application) you provide to us. All Materials you upload remain yours. You can remove it from your Bebs store at any time by deleting your Account.

By uploading Materials, the user agrees:

  • to allow other users to view the Materials you post publicly in the App;
  • to allow Bebs to store, and in the case of Materials you post publicly, display and use your Materials; and
  • that Bebs can, at any time, review and delete all the Materials submitted to its Service, although Bebs is not obligated to do so.
  • Bebs does not own any of the Materials that are uploaded by the users on the App. The ownership over all the Materials are retained by the users, and you are responsible for compliance with the applicable laws or regulations of the jurisdiction.
  • Any licenses, Intellectual Property Rights associated with the user’s Materials, logo, tradename, and such other associated licenses shall remain with the user only. Bebs shall not have any right over such licenses and Intellectual Property Rights.
  • Bebs may use the tradename, logos, and service marks of the user to promote our Services.

7. Copyright Infringement Complaints

If the user is of the opinion that there has been a reproduction of any work on this App in a manner that amounts to copyright infringement, kindly provide a notice of copyright infringement by emailing [email protected] stating the following information at the mentioned address:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material on our App that is claimed to be infringing or to be the subject of infringing activity.
  • The address, telephone number, or e-mail address of the complaining party.
  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner for the purposes of the complaint
  • A statement, under penalty of perjury, that the information in the notice of copyright infringement is accurate, and that the complaining party is authorized to act on behalf of the owner of the right that is allegedly infringed.
  • A statement that the complaining party has a good-faith belief that the Service of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

8. Account Registration and Access to use

By accessing or using our Services, you confirm that you can form a binding contract with Bebs, that you accept these Terms, and that you agree to comply with them. Your access to and use of our Services is also subject to our Privacy Policy, and Cookies Policy, the terms of which can be found directly in the App. By using the Services, you consent to the terms of the Privacy Policy of the App. 

In order to use the services, you must first agree to Bebs’ Terms of Service. You may not use the Services if you do not accept the Terms.

You can accept the Terms by:

  • Clicking to accept or agree to the Terms, where this option is made available to you by Bebs in the user interface for any Service; or
  • By actually using the services. In this case, you understand and agree that Bebs will treat your use of the Services as acceptance of the Terms from that point onwards.

You may not use the Services and may not accept the Terms if:

  • you are not of legal age to form a binding contract with Bebs or 
  • you are a person barred from receiving the services under the laws of the USA or other countries including the country in which you are resident or from which you use the Services
  • you may not use the Services if you do not accept the Terms.

9. Prohibited Conduct

By accessing or using the mobile app, you agree that you will not engage in any of the following activities:

  • Use the app for any illegal purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the app, or any other systems or networks connected to the app.
  • Upload or distribute any content that is infringing, defamatory, abusive, harassing, obscene, or otherwise objectionable.
  • Interfere with or disrupt the app, its servers, or its networks, or otherwise attempt to circumvent any security or authentication measures.
  • Engage in any activity that is intended to or could damage, disable, overburden, or impair the app or any part of it.
  • Use the app to send unsolicited commercial or advertising messages or spam, or to engage in any other form of unsolicited or unauthorized communication.
  • Use the app to collect or store personal information about other users without their consent.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Use the app to engage in any fraudulent, deceptive, or misleading activity.
  • Use the app to transmit any viruses, malware, or other harmful code, or to attempt to interfere with the proper functioning of any software, hardware, or equipment.

We reserve the right to investigate and prosecute violations of any of the above, to the fullest extent of the law. Any such violation may result in the termination of your access to the app, as well as any other legal remedies that we may be entitled to pursue.

10. Publication Policy

Users of Bebs may not host, display, upload, modify, publish, transmit, update, or share certain types of content (Prohibited Content) listed below:

  • that belongs to another person and to which the User does not have any right;
  • that is harmful, harassing, defamatory, obscene, pornographic, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, or otherwise unlawful in any manner;
  • that infringes any patent, trademark, copyright, or other proprietary rights;
  • that violates any applicable law or regulation;
  • that deceives or misleads others about the origin of such messages or communications any information which is grossly offensive or menacing in nature;
  • that impersonates another person;
  • that contains malware or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
  • that threatens the unity, integrity, defense, security, or sovereignty of the USA, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognizable offense, or is insulting to any other nation.

This policy aims to ensure that users of Bebs do not engage in any illegal, unethical, or inappropriate behavior while using the platform. By agreeing to the terms of use, users acknowledge and accept this publication policy and commit to complying with it. The company reserves the right to take appropriate action against any user who violates this policy.

11. Acceptable Use Of Our Services

Acceptance of Terms: By using our mobile app ("the Services"), you agree to be bound by these Terms of Service and any posted policies or guidelines. If you do not agree to these terms, you may not use our Services.

Legal and Acceptable Use: You agree to use our Services only for legal, authorized, and acceptable purposes. You must not use our Services in any way that violates any laws or regulations, infringes upon the rights of others, or is otherwise harmful or offensive.

Prohibited Conduct: You agree not to use our Services in any way that:

  • Violates or infringes upon the rights of Bebs, our users, or any third party, including intellectual property rights, privacy rights, or other proprietary rights.
  • Is unlawful, obscene, defamatory, threatening, intimidating, harassing, hateful, racially or ethnically offensive, or otherwise inappropriate.
  • Involves publishing false, misleading, or deceptive information or impersonating someone else.
  • Involves sending unsolicited or unauthorized messages, advertising, or promotional material.
  • Involves any non-personal use of our Services without our prior authorization.

Prohibited Actions: You agree not to engage in any of the following activities:

  • Accessing, copying, or modifying any part of our Services in any unauthorized or impermissible manner
  • Distributing or making our Services available over a network where they could be used by multiple devices at the same time
  • Attempting to gain unauthorized access to our Services or systems, or interfering with or disrupting the performance of our Services.
  • Using our Services in any way that burdens, impairs, or harms our Services, systems, or users.
  • Creating accounts for our Services through unauthorized or automated means.
  • Collecting information about our users in any impermissible or unauthorized manner.
  • Selling, reselling, renting, or charging for our Services.
  • Sending or transmitting viruses, malware, or other harmful code through or onto our Services

Account Security: You are responsible for maintaining the security of your account and device, and you must notify us immediately of any unauthorized use or security breach of your account or our Services.

Enforcement: We reserve the right to monitor, investigate, and enforce these Terms of Service and any policies or guidelines posted on our Services. We may take any action we deem appropriate, including suspending or terminating your account or restricting your access to our Services. We may also report any unlawful activity to the appropriate authorities.

12. «Connect with Confidence: Your Safety is Our Priority»

By using our Services, you agree to treat other users respectfully and with courtesy, whether you are communicating on or off our platform. This applies to interactions with our customer care representatives and other employees as well. While we encourage respectful behavior through features such as double opt-in, which allows communication only between members who express mutual interest, we cannot be held responsible for the actions of our members outside of our platform. Therefore, we recommend that you exercise caution when interacting with other members, especially if you decide to communicate off our platform or meet in person. Before using our Services, you should also review and follow our Safety Tips. Additionally, you must not provide any financial information or send money to other members.

You are solely responsible for your interactions with other members. We do not conduct criminal background checks on our members or inquire into their backgrounds. We make no representations or warranties about the conduct or compatibility of our members. However, we reserve the right to conduct criminal background checks or other screenings, such as sex offender register searches, using public records obtained by us or with the help of a consumer reporting agency. Any information you provide may be used for this purpose, and you authorize us to do so.

13. Purchases

In general, Bebs may provide products and services for purchase ("in-app purchases") through authorized platforms such as the App Store, Google Play Store, carrier billing, direct billing, or other payment platforms. When making an in-app purchase, you will be required to confirm the transaction with the applicable payment provider. Your chosen Payment Method, whether it's a card or a third-party account like Google Play Store or the App Store, will be charged for the selected service(s) at the displayed prices, along with any applicable sales taxes. By proceeding with the purchase, you authorize Bebs or the applicable third-party account to charge you. Auto-Renewal: If you subscribe to an auto-recurring periodic subscription through an in-app purchase, your Payment Method will be billed until you cancel. After each subscription period, it will automatically renew at the agreed-upon price. You can manage or cancel your subscription through your third-party account or the Settings, even if you delete your account or the Bebs application. Deleting your account or the app does not cancel your subscription, and Bebs will retain charged funds until you cancel your subscription.

Additional Terms for Direct Payments: If you pay Bebs directly, any billing errors or mistakes may be corrected by Bebs even after payment. Initiating a chargeback may result in immediate account termination at Bebs discretion. You can edit your Payment Method information through Settings on Bebs If a payment fails and you don't update your information or cancel your subscription, you remain responsible for any outstanding amounts. Bebs is authorized to continue billing the Payment Method, potentially changing your payment billing dates. Virtual Items: Bebs offers virtual items, including virtual products or "crystals for purchase or earning within the service. Virtual items have no real-world value, and their license terminates according to the terms, service cessation, or account closure. Bebs reserves the right to charge fees for virtual item access and can manage or eliminate virtual items at its discretion. Purchases and redemptions of virtual items are final and non-refundable. Refunds: Generally, all purchases are nonrefundable. Exceptions may be made for subscription refunds requested within fourteen days of the transaction date or as required by applicable laws. For specific states, cancellation terms apply, and purchasers in certain states may be entitled to refunds under specific circumstances.

For subscribers residing in Arizona, California, Colorado, Connecticut, Illinois, Iowa, Minnesota, New York, North Carolina, Ohio, and Wisconsin, the following conditions are applicable: You have the option to cancel your subscription without incurring any penalties or obligations at any time until midnight on the third business day following the subscription date. If, unfortunately, your demise occurs before the subscription period concludes, your estate is eligible for a refund corresponding to the portion of any payment made for the subscription allocated to the period post your demise. In the event of disability before the subscription period's conclusion, you hold the right to a refund for the portion of any payment made for the subscription allocable to the period after your disability. This can be obtained by providing notice to the company in the same manner as when requesting a refund, as described below. The purchase of Virtual Items is deemed FINAL AND NON-REFUNDABLE.

To request a refund: Apple ID: Refunds are handled by Apple. Visit the App Store, click on your Apple ID, select "Purchase history," find the transaction, and hit "Report Problem." Google Play Store or Direct Subscription: Contact customer support with the order number for the Google Play Store or Bebs along with necessary details. Alternatively, email a cancellation notice to Bebs - [email protected] Pricing: Bebs pricing is influenced by various factors, and promotional rates may vary by region, subscription length, bundle size, and more. Bebs regularly tests new features and payment options.

When you purchase a subscription on web.bebs.app, it's important to understand that if you already have a subscription bought through the Apple Store or Google Play, that subscription will be cancelled. However, it's crucial to note that there is no refund for the unused portion of the subscription. This is standard practice for most services and applications offering subscriptions, where changing the subscription method (for example, from one platform to another) results in the cancellation of the previous subscription without the possibility of a refund for the remaining time.

Also, when upgrading a subscription on web.bebs.app, there is no proration or refund for the unused portion of the previous, lower-level subscription. This means that when you switch to a subscription with a broader set of features or a longer duration, the remaining value of your previous subscription will not be taken into account in the cost of the new subscription.

14. Notification to Subscribers from California

Dear subscribers in California, we want to remind you that you have the option to cancel your subscription and request a refund up until midnight on the third business day after your subscription date. If you enrolled using your Apple ID, please note that Apple will handle your refund, not Bebs. To request a refund, kindly visit https://getsupport.apple.com. However, if you subscribed through Bebs or your Google Play Store account, please contact our customer support team.

15. Third-Party Services

The Service may feature advertisements and promotions presented by third parties, as well as links to other websites or resources. Please note that Bebs is not accountable for the availability (or unavailability) of these external websites or resources. If you decide to engage with any third parties that are made available through our Service, please be aware that their terms will apply to your relationship with them. Bebs cannot be held responsible or liable for the actions or terms of these third parties.

16. Indemnity & Limitation of Liability

Indemnification: You agree to defend, indemnify and hold harmless the App and the Company, including their directors, employees, agents, affiliates, successors, and assigns, from and against any and all claims, damages, losses, liabilities, expenses, and costs (including reasonable attorneys' fees and court costs), arising out of or in connection with your use of the Application, your violation of any term of this Agreement, or your violation of any rights of a third party. The Company/App reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify the Company/App, and you agree to cooperate with our defense of these claims.

Limitation of Liability: In no event shall the Company/App, its directors, employees, agents, affiliates, successors, or assigns be liable for any indirect, special, incidental, consequential or punitive damages, including without limitation, loss of profits, loss of data, loss of use, or any other economic or commercial damages, arising out of or in connection with your use of the Application, even if the Company/App has been advised of the possibility of such damages. In no event shall the total liability of the Company/App, its directors, employees, agents, affiliates, successors, or assigns, whether in contract, tort (including negligence), or otherwise, exceed the amount paid by you, if any, for accessing the Application.

17. Arbitration Agreement

In the event of any dispute or claim arising out of or related to your use of our mobile app, you and the company agree to resolve the matter through binding arbitration instead of court proceedings. This includes, but is not limited to, disputes related to the mobile app's features, performance, and user experience, as well as issues related to privacy, intellectual property, and contract disputes.

By agreeing to this arbitration agreement, you and the company waive any right to participate in a class action or collective arbitration, and you also waive your right to a jury trial. The arbitration will be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association. The decision of the arbitrator will be final and binding on both parties, and any judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

18. Policy on Virtual and Real Items, Invite to Dinner Function, Referral Program Rules, and Bebs Card Use

By using our mobile app, you agree to the following policies:

  • Policy on Virtual Items: Any virtual items or currency available on our app, including but not limited to coins, tokens, and digital gifts, can only be used within the app and cannot be exchanged for real currency. We reserve the right to modify, limit, or revoke the use of virtual items or currency at any time without notice or compensation.   • Policy on Real Items: If the app includes the sale of real items, we will make clear the price, terms of sale, and return policy. We reserve the right to change the prices and availability of real items at any time without notice and also grant such a right to third parties.   • Policy on Invite to Dinner Function: The Invite to Dinner function allows you to invite other app users to a real-life dinner. By using this function, you agree to abide by any rules and guidelines set forth by the app, including but not limited to meeting in a public place, treating others with respect, and following all local laws and regulations.   • Referral Program Rules: The Referral Program rewards users who refer new users to the app. The rules of the Referral Program will be clearly stated on the app and are subject to change at any time without notice. 19. Applicable Law

These Terms of Service shall be governed, interpreted, and construed in accordance with the laws of the state of Delaware and the federal laws of the United States. Any legal proceedings related to these Terms of Service shall exclusively take place in Dover, Delaware, and shall be conducted in the English language.

20. Entire Agreement; Severability

These Terms of Service, along with the Privacy Policy, Cookies Policy, and any additional agreements entered into between you and Bebs, constitute the entire agreement between both parties regarding the Service. If any term, provision, covenant, or restriction in these Terms is deemed invalid, void, or unenforceable, the remainder of the terms and provisions will remain in full force and effect, and will not be affected, impaired, or invalidated.

21. Amendments to the Terms of Service

As we continually strive to enhance and improve our services, we may need to modify our Terms of Service from time to time. By using our mobile app, you agree to track any changes made to the Terms of Service. However, we recommend that you regularly review the Terms to stay informed. The date of the last update will be displayed below the "Terms of Service" caption. Your continued use of our services after any updates to the Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, please refrain from using our services and close your account. Please note that we may not provide prior notice for changes related to security, safety, legal or regulatory requirements, but we will notify you as soon as possible.
